Terms of Service

Last updated: 20 October 2026

1. Our design service

Design Biscuit provides ongoing graphic design support from a senior Australian designer, with approximately 3–4 hours of design capacity per working day, Monday to Friday. This is ongoing part-time design support, rather than a full-time dedicated hire.

You may queue unlimited requests in Trello. We work through them one at a time, from most urgent to least urgent. Unlimited requests means an unlimited queue, not unlimited simultaneous work or a guaranteed number of completed designs.

Services can include social content and templates, digital advertising, print collateral, email design and website graphics. Deliverables and priorities are agreed around each brief.

2. Plans, pricing and billing

All prices are in Australian dollars (AUD), with GST added as shown.

12-month partnership: $5,800 every four weeks + GST, with a fixed 12-month commitment. Optional client-requested pauses are not included.

Flexible plan: $6,700 every four weeks + GST, with no long-term commitment and the ability to pause or cancel as set out below. It renews every four weeks unless paused or cancelled.

Billing is every four weeks, not by calendar month. Invoices are issued seven days before the next paid cycle and are due within seven days or by its start date. Work starts or resumes after payment is received. Secure online payment methods are available.

3. Scheduled breaks and public holidays

We take one week off over Easter, Christmas week and two weeks in January: four weeks of scheduled breaks each year. No design work is completed and you are not billed for these closure periods. Billing is adjusted so paid subscription time is not used during a scheduled closure. We work through other public holidays.

These scheduled breaks apply to both plans and are separate from optional pauses on the flexible plan.

4. Flexible-plan pauses and cancellation

You may request a pause at any point in your four-week cycle. If an active job is in progress, the pause takes effect once that job is completed.

The paid cycle is not refunded simply because you pause. Unused subscription days remaining when the pause takes effect are held as credit and used when you resume. Credit must be used within 12 months of the pause date; after that it expires. Credit is subscription time, not a cash refund.

You may cancel the flexible plan at any time by contacting us. Cancellation stops future renewals; completed work and fees already paid are not refundable for change of mind, subject to your rights under applicable law.

5. 12-month commitment and early cancellation

The 12-month plan is a fixed-term agreement. Payments remain due for the agreed term unless an early-cancellation arrangement applies.

If you choose to cancel within the first three paid billing cycles, one additional four-week payment of $5,800 + GST is payable, in addition to fees already paid.

If you choose to cancel after the first three paid billing cycles, the cancellation fee is 40% of the remaining contract value: the subscription fees for the remaining agreed billable cycles in your 12-month term. Scheduled unbilled closure periods are excluded from that calculation.

Services continue until the end of the current paid cycle. These conditions do not limit rights or remedies that cannot be excluded under applicable law.

6. Requests, timing and client responsibilities

Submit briefs, files and feedback through your shared Trello board. Provide clear instructions, accurate content, suitable images and any existing brand guidelines. You are responsible for having permission to use materials you supply and for maintaining the confidentiality of your account details.

Most everyday requests are delivered within 1–2 business days once they become active. Queue position, complexity, revisions and the completeness of a brief can affect timing. Larger projects are broken into stages, with timings agreed upfront. No fixed number of deliverables is promised per cycle.

You are responsible for checking and approving content, accuracy and the lawful use of your supplied materials. We do not guarantee specific business or marketing results.

7. Revisions, deliverables and source files

Subscription requests include unlimited revisions and source files. We will work with you to address feedback and refine the design. Requests and revisions are prioritised through the same queue and use your available design capacity.

Third-party assets, stock images and fonts remain subject to their own licence conditions. Specialty stock and font licence costs are additional and will be approved by you before purchase.

8. One-off projects and additional services

Logos, brand development, brochures, campaigns and websites may also be quoted as standalone projects. Scope, deliverables, timing, payment arrangements and any revision limits are agreed in writing before work begins.

Copywriting, photography, video production and brand strategy are not included unless agreed in writing. Work outside your agreed subscription scope, including website builds or larger standalone brand projects, is separately scoped and quoted.

9. Privacy and confidentiality

We handle client information and project details confidentially and take reasonable measures to protect them. Our Privacy Policy explains how personal information is collected, used and disclosed.

10. Quality, refunds and your rights

If you are unhappy with a design, let us know so we can address your feedback through revisions. We do not provide change-of-mind refunds for completed design work.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under Australian Consumer Law or other applicable law that cannot lawfully be excluded, restricted or modified.

11. Portfolio and confidential projects

We may showcase completed design projects in our portfolio or marketing. Tell us in writing if a project must remain confidential or must not be shown before launch; we will not display work you have explicitly requested remain confidential. You may also give written consent for a project to be showcased.

12. Promotions, changes and agreement

Promotional offers are subject to the conditions stated when offered. These terms and any agreed written scope or plan form the agreement for your engagement.

We may update these terms from time to time and publish the updated version. Any changes affecting an existing agreed engagement will be communicated to you; they do not override rights that cannot be excluded by law.

Australian law applies. Any court proceedings are subject to the jurisdiction of the Australian courts.
